SITHA App - Terms of Use

1.Acceptance of Terms

By accessing or using the SITHA by SheJobs mobile application and website (collectively, the “Platform”), you agree to these Terms of Use (“Terms”). If you do not agree with any part of these Terms, please do not use the Platform.

2. Modifications to Terms

We may modify these Terms at any time. Updated Terms will be posted on the Platform and take effect immediately. Continued use of the Platform constitutes acceptance of the revised Terms.

3. Eligibility and Account Registration

• Eligibility: You must be at least 18 years old and legally capable of entering into contracts.
• Registration: You agree to provide accurate, complete, and current information. You are responsible for safeguarding your credentials and all activity under your account.

4. Use of the Platform

• 4.1 Purpose & User Obligations: SITHA is an intermediary marketplace connecting customers with verified providers and sellers. You agree to use it lawfully and not to disrupt or interfere with its operation.


• 4.2 Content License: By submitting content (profiles, photos, reviews), you grant SheJobs a non‑exclusive, worldwide, royalty‑free license to use and distribute it in connection with the Platform.


• 4.3 Food & Beverage Compliance: Any provider offering food or beverage (“F&B Seller”) must:
• Hold a valid FSSAI registration or license.
• Maintain a registered business entity (GSTIN, Shop & Establishment, etc.).
• Comply with all labeling, hygiene, and advertising laws.
• Indemnify SITHA against any claims or penalties from non‑compliance.
SITHA disclaims liability for the quality or legality of any products or services listed.


• 4.4 Professional Licensing & Skill Verification:
• Mandatory Credentials: Regulated services (medical, legal, electrical, plumbing, engineering, etc.) require valid, jurisdiction‑specific licenses. Partners must upload clear copies before accepting bookings.
• Ongoing Monitoring: Automated reminders 30 days before expiry; suspension of listings if credentials lapse; partners must notify SITHA within five business days of any suspension or revocation.
• Skill Verification: Specialized skills demand proof of third‑party training or certification. SITHA may verify credentials with issuers or approved third‑party verifiers.
• Document Submission: Partners must upload clear, legible copies of each required license or certification (e.g., medical council registration, bar admission) before accepting any bookings.
• Audit Rights: SITHA reserves the right to verify any uploaded credential directly with the issuing authority or through an approved third-party verifier.


• 4.5 Prohibited Goods & Services:

The following are strictly prohibited:

• Controlled Substances: Ban all prescription drugs, narcotics, and psychotropics regulated under India’s NDPS Act or the U.S. Controlled Substances Act (CSA).
• Firearms & Weapons: Prohibit sale or listing of firearms, ammunition, weapon accessories, explosives, or any device designed to inflict bodily harm.
• Regulated Advice & Services: No financial products or payment services requiring RBI, FED or SEC approval may be offered unless the provider holds the relevant license.
• Age/Region-Restricted Items: :Adult content must be strictly age-gated in compliance with local obscenity laws.Tobacco, vaping, and CBD/cannabis products are permitted only where the seller holds a valid license in that jurisdiction.
• Enforcement & Remedies: Immediate removal of offending listings, suspension of the user’s account, and, where appropriate, referral to law enforcement authorities. Offending users indemnify SITHA against any claims, fines, or penalties arising from violations.


• 4.6 Personal Safety & Insurance:
• No Coverage Disclaimer: SITHA does not insure against injury or property damage during in‑person visits.
• Separate Coverage Recommended: Users should obtain their own liability and property insurance. High‑risk services may require proof of commercial or malpractice insurance.


• 4.7 Exchange of Sensitive Information:
• Any sharing of personal, financial, medical, or other sensitive data between users is at each party’s risk. SITHA’s Privacy Policy governs only data it collects directly, not peer‑to‑peer exchanges.
• Users should obtain their own liability and property insurance. High‑risk services may require proof of commercial or malpractice insurance.


• 4.8 Background Checks & Credentialing:
Partners are responsible for any criminal background checks or references. SITHA’s review is limited to document receipt and does not independently validate accuracy.


• 4.9 Code of Conduct & In‑Person Safety:
Harassment, discrimination, or unlawful behavior during in‑person visits is grounds for immediate suspension. Partners must adhere to health, safety, and hygiene protocols.


• 4.10 High‑Risk Service Insurance & Indemnity:
High‑risk services (electrical, plumbing, medical) require commercial general liability - and, if applicable, malpractice - insurance. Partners must indemnify SITHA against any claims arising from these services.


• 4.11 Data Privacy & Cross‑Border Compliance:
SITHA’s Privacy Policy governs personal data handling in compliance with DPDP, GDPR, and CCPA as applicable. Export‑controlled or sanctioned items are prohibited. Users are responsible for any GST/VAT or other duties in their jurisdiction.


• 4.12 Account Suspension & Termination:
Grounds include policy breaches, credential lapses, safety incidents, or legal violations. Notice procedures, temporary suspension, and permanent termination will be followed. Active bookings and escrowed funds will be handled per Section 7.


• 4.13 Dispute Resolution Enhancements (U.S.):
For U.S. operations, a class‑action waiver and a liability cap equal to fees paid in the prior 12 months apply. Force majeure events excuse performance obligations.


• 4.14 Severability & Waiver:
If any provision is unenforceable, the remainder stays in effect. Failure to enforce any right does not constitute a waiver unless in writing.


• 4.15 Ongoing Partner Duties:
Partners must update SITHA within five business days of any change to credentials, legal status, or insurance. Regulatory actions (suspensions, investigations) must be reported within five business days.

5. Intellectual Property Rights

All Platform content - text, graphics, logos, images, software is owned by SheJobs or its licensors. You agree not to reproduce, modify, or distribute any content without written permission.

6. Payment, Transactions, and Fees

• Payment Processing:Through partnered gateways; additional provider terms may apply.
• Fees:Set by individual providers; displayed at checkout.
• Refunds & Cancellations: Governed by our Cancellation & Refund Policy.

7. Cancellation and Refund Policy

• 7.1 By Customers:
• Free Cancellation: ≥ 8 hours before service.
• Partial Refund: 2 to 8 hours before, 50% fee.
• No Refund: 2 hours or no‑show.


• 7.2 By Providers:
• Provider Cancellation: Full customer refund; repeated cancellations may lead to suspension.


• 7.3 Unforeseen Circumstances:
Full refund or reschedule at no extra cost.


• 7.4 Refund Process:
Requests within 48 hours; processed in 5 to 7 business days to original method or as credits.

8. Disclaimers and Limitation of Liability

• No Warranty: The Platform is provided “as is,” without express or implied warranties.
• Limitation of Liability: SheJobs is not liable for indirect, incidental, or consequential damages.
• Intermediary Role: We do not guarantee service quality; disputes are to be resolved between users and providers per Section 4.12.

9. Indemnification

You agree to indemnify and hold harmless SheJobs and its affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Disputes will be resolved first by negotiation, then by binding arbitration under the Arbitration and Conciliation Act, 1996.

11. Entire Agreement

These Terms, together with our Privacy Policy and Cancellation & Refund Policy, constitute the entire agreement between you and SheJobs regarding your use of the Platform.
